In the Paint description, under the Items rule, change:

A unit of Paint may be used by a Player to change one of the Color Codes in the Square e is on to the color of the Paint.

to

A unit of Paint may be used by a Player to change one of the Color Codes in the Square e is on to the color of the Paint, provided the Square to be so painted does not already have that color code.

against I don’t see a problem with painting something the same color. It is just a waste of paint. The fact that a square can have 2 or more of the same color code is a problem with rule 13.1, not the paint item.
